General Listing Procedures

Canopy MLS Subscribers must submit all Exclusive Right to Sell and Exclusive Agency listings to Canopy MLS, except under the following circumstances.

  • Properties for lease
  • If the Seller refuses to permit the listing to be disseminated by Canopy MLS, the Listing Brokerage must submit a certification signed by the Seller that he/she does not desire the listing to be disseminated by Canopy MLS within two business days from the “Effective Date” (or if applicable the “Marketing Date” as it is known in North Carolina) or the beginning date of the term of the listing (for South Carolina). Canopy MLS recommends use of the “Firm Exclusive Agreement” form.  MLS Member Participants must distribute Firm Exclusive listings within one (1) business day once the listing is publicly marketed. 
  • Listings of property located outside the Canopy MLS Service Area.
  • Commercial listings
  • Canopy MLS does not regulate the type of listings its members can take. However, Canopy MLS does not accept Net or Open listings.

Listings submitted to Canopy MLS must have these characteristics:

  • The subject of the listing must be real property for sale, exchange or lease. The MLS has had members who have tried to list businesses, manufactured homes on rented lots, campers, flea market booths and other non-real-property items for sale, but these items are not appropriate for the MLS. 
  • The listing must belong to a real estate brokerage, and be subject to a Broker-in-Charge.
  • The listing must qualify for one of the following property categories: 1) residential, 2) residential multi-unit, 3) lots/acres/farms, 4) commercial sale, 5) commercial lease or 6) residential lease.
  • The listing must be taken on an Exclusive Right to Sell or an Exclusive Agency listing agreement.
  • All owners having an ownership interest should sign the listing agreement. When the Seller of a property does not hold title but has a contract to receive title on the property, the Listing Brokerage must indicate, "Seller does not yet own," in the "Ownership Period" field.
  • The listing agreement and property data form must be complete in every detail which is reasonably ascertainable. Member Participants and Subscribers are required to submit accurate listing data and required to correct any known errors. 
  • The listing brokerage must include the full gross-listing price stated in the listing agreement in the listing submitted to Canopy MLS.
  • Listings submitted to Canopy MLS must include the final termination date as negotiated between the listing brokerage and the Seller.

 

The Listing Brokerage must input each listing required to be submitted to Canopy MLS within one (1) business day of the Effective Date (or if applicable the "Marketing Date" as it is known in North Carolina) or the beginning date of the term of the listing (for South Carolina), or within one (1) business day of marketing the listing to the public, whichever occurs first.
