The examples below are recent and actual statements written by listing agents and entered into Canopy MLS in violation of the Rules and Regulations. These statements relate to compensation which is strictly prohibited from being placed in any MLS field. Although the NAR Settlement Agreement does not address listings of lots/acres/farms, rentals, and commercial, ALL listings in the MLS in ALL PROPERTY CATEGORIES are prohibited from including an offer of compensation, which also includes payment of a referral fee. Examples of recent violations:
- Please text a request with your email address and the property address to ###-###-#### for a copy of the report and BAC info.
- ABC Realty will gladly pay a referral fee. Referral requests may be submitted via www.abcrealty.com.
- Agent must show unit to be eligible for referral fee.
- Agent friendly opportunity to co-broker this sale.
- Please call or email with any questions. abccompensates.com
- Please submit form 220 with all offers.
CAUTION: If there is a registration fee or tech fee imposed for offer submission, that can be noted in the MLS listing; however, the listing must not indicate who must pay the fee. Stating, “a $295 tech fee must be paid or due at closing” is okay. However, stating, “there is a buyer’s agent technology fee of $295 at closing,” is NOT okay because it could be construed that the technology fee is deducted from buyer agent compensation.
